How Liability Works for Injuries Caused by Animals Other Than Dogs in Illinois

When most people think about animal injury cases, they think about dog bites. And it’s true, Illinois has one of the strongest dog bite laws in the country. But dogs aren’t the only animals that can cause harm. Livestock, exotic pets, and even animals kept for entertainment can injure people. If you’ve been hurt by an animal that isn’t a dog, here’s what you need to know about how liability works in Illinois.

Illinois Law Covers More Than Just Dogs

Illinois has a specific statute (the Animal Control Act (510 ILCS 5/16)) that holds owners strictly liable for injuries their animals cause. While it’s often referred to as the “dog bite law,” the statute really applies to any animal that causes injury.

Under the law, if an animal attacks, attempts to attack, or injures someone who’s acting peacefully and lawfully, the owner is liable, period. You don’t have to prove negligence, only that:

  1. The animal caused the injury.
  2. You were lawfully present where it happened.
  3. You didn’t provoke the animal.

Livestock and Farm Animal Injuries

Farm-related injuries can be particularly complex. Horses, cows, pigs, and other large animals can cause serious harm.

Here’s how Illinois courts tend to view these cases:

  • Strict Liability Applies: The Animal Control Act still covers livestock, so if a horse kicks a visitor or a bull escapes and injures someone, the owner can be held liable without proof of negligence.
  • Fencing and Containment Laws: In rural areas, additional local “fence laws” may apply.
  • Comparative Fault: If the injured person ignored warnings or provoked the animal, the owner might argue for reduced liability under Illinois’ modified comparative fault system.

Exotic Pets and Wild Animals

Illinois restricts ownership of certain exotic animals, but some people still keep them illegally or under special permits. Think snakes, big cats, primates, or other non-domesticated species.

In these cases, liability often goes beyond the Animal Control Act. Courts recognize that wild or exotic animals are “inherently dangerous.” That means their owners are typically held to a standard of absolute liability.

When Animals Escape and Cause Damage

Another common scenario involves escaped animals, livestock wandering onto roads, for example. If you’re injured in a car crash caused by a cow or horse that got loose, the animal’s owner may still be liable under the Animal Control Act or under common law negligence.

The big question is whether the owner took reasonable steps to prevent the animal from escaping. Poor fencing, broken gates, or failure to monitor the animals can indicate negligence.

Recovery After an Animal-Related Injury

Whether you were kicked by a horse or bitten by an exotic pet, you have rights under the law. The Animal Control Act and common law both hold owners accountable for failing to control their animals, regardless of whether that animal is a family pet or a farm fixture.
