After suffering a personal injury, one of the most common questions people ask is how much they may be able to receive. Unfortunately, no standard number can be applied to various injuries. All personal injury cases are different. Even if they seem similar from the outside, many factors are involved to make each case unique. Experienced attorneys can’t provide you with a finite answer as to the worth of your claim.
Some of the main factors examined include your liability for the injury and the nature of the claim. Were you partially or mostly at fault for the accident? How severely has the injury impacted your life?
The damages claimed can also affect the claim amount. Types of damages that can be claimed include your current and future medical expenses, current and future wage losses, pain and suffering, disability, disfigurement, and emotional distress. Some of these have tangible dollar amounts attached to them. Others, such as emotional distress, are not as easy to decipher.
Not all injury claims will go to trial. Often, they will be settled out of court. In some cases, they could even be dismissed. For example, if there is insufficient evidence or the injured party had a high degree of fault for the injury, the case will be dismissed.
Some people or companies may want to settle, so they don’t have to go to court in what could be a high-profile case they would rather avoid. Other times, they don’t mind going to court and won’t offer to settle because they believe they were in the right or they believe they can outlast you in court.
If the company does try to settle, you have to beware. They may offer an amount that’s less than you should get. They just hope you will take a fast settlement, so they can be done with the case. This is one of the reasons you need to have an attorney working for you. They have your best interests in mind and want you to get as much for your claim as possible.
Grewer Law Group will never guarantee a settlement or claim amount. What they will do is represent you and ensure your rights are protected. If you have a personal injury, get in touch with a lawyer as soon as you can.
