Understanding Vaccine Injury Claims

What Is a Vaccine Injury Claim?

A vaccine injury claim is a legal request for compensation filed through the National Vaccine Injury Compensation Program (VICP), a federal program established in 1986. The VICP was designed to provide financial support to individuals who suffer serious side effects from routine vaccinations while protecting vaccine manufacturers from excessive litigation and ensuring vaccine availability.

Common Vaccine-Related Injuries

Although the VICP has recognized rare, specific adverse reactions to vaccines. These may include:

  • Guillain-Barré Syndrome (GBS)
  • Anaphylaxis (severe allergic reaction)
  • Shoulder Injury Related to Vaccine Administration (SIRVA)
  • Chronic arthritis
  • Encephalopathy or seizures in children

Each case is unique, and not all adverse reactions qualify. However, the VICP maintains a Vaccine Injury Table that outlines which injuries are covered and the timeframe in which symptoms must appear.

Who Can File a Claim?

Claims can be filed by individuals who received a covered vaccine and experienced an injury, parents or guardians of an injured child, or legal representatives of someone who has died as a result of a vaccine-related injury. Most claims must be filed within three years of the first symptom of injury or within two years of a vaccine-related death.

What Compensation Is Available?

If your claim is successful, compensation can include:

  • Medical expenses
  • Lost wages or future earnings
  • Pain and suffering (up to $250,000)
  • Death benefits in fatal cases

The program often covers legal fees, whether or not the claim is successful, as long as it was filed in good faith.
