Nursing Home Injury

Nursing Home Care Act

Nursing Home Abuse or Nursing Home malpractice occurs while a patient or resident of a nursing home or licensed skilled nursing facility is harmed physically, mentally or sexually while under the care of that facility. Harm caused by nursing homes in the State of Illinois is so prevalent that the Illinois State legislature has enacted legislation specifically to address these harms. This legislation is called the Nursing Home Care Act.

Nursing home residents are especially vulnerable to their care takers. This environment should be a safe haven that provides for skilled nursing care in a tranquil environment. Residents are on site 24 hours aday seven days a week. This is supposed to be their home. The terminology is even different in the nursing home. Nursing homes generally do not refer to their clients as patients, but as residents. Unfortunately, nursing homes often are more interested in the bottom line and the staff is often times unhappy and jaded. If a loved one has suffered physical, mental or sexual injuries while under the care of a nursing home, they may be entitled to compensation.

Examples of some of these injuries include:

  • Death
  • Brain Damage
  • Broken Bones
  • Bed Sores
  • Bruising
  • Malnutrition
  • Dehydration
  • Sexual Abuse
  • Physical Abuse
  • Verbal Abuse
  • Intimidation
