National Vaccine Compensation Program

Although Vaccine injury is rare, it can be catastrophic. The Federal Government recognized the importance of vaccines, but needed to balance vaccine administration with the injuries that sometimes can occur. In response to addressing these competing interests, the United States Legislation established the National Vaccine Compensation Program or VICP. The VICP is a no-fault alternative to the traditional civil litigation for resolving vaccine injury claims that provides compensation to people found to be injured by certain vaccines. The compensation awarded comes from a VICP Compensation Trust Fund that is derived from a tax levied on vaccines.

 

You may be eligible for compensation if you believe you were injured by a vaccine, you are the parent or legal guardian of a child or disabled adult believed to have been injured by a vaccine or the legal representative of the estate of a deceased individual whose death you believe was caused by a vaccine. An in depth investigation should be done to properly file this action in the Federal Court of Claims. In most cases, a vaccine injury must have lasted for at least more than 6 months after the vaccine was given or resulted in a hospital stay and surgery.

Federal Statute addresses Attorney’s Fees and reimbursement of expenses. The fees and expenses associated with the litigation is not paid by the Plaintiff, but is paid for separately by the National Vaccine Compensation Program Trust.
